Narrative

On December 4, 2023, in Irving, Texas, an officer surveilled me in a public place for over 15 minutes without any indication I had committed or was about to commit a crime. When I confronted him, he repeatedly said I was free to go; I replied that if I was free to go, I was free to stay. His continued observation made me feel detained. About six minutes into our encounter, another officer arrived and overheard me expressing that I did not want to be subjected to profiling. The second officer then sarcastically questioned why I felt profiled. Without conducting any sobriety tests, Officer Markham arrested me for public intoxication, alleging I was a danger to myself—an unsupported claim. At the jail, I was confined in a freezing cell without a mattress, blanket, or shoes, unlike other inmates. My requests to contact a lawyer were ignored, and I was coerced into answering questions under duress under threat of being placed in a straitjacket.

Desired outcome

Officer Markham should be charged with Deprivation of Rights Under Color of Law (18 U.S.C. § 242), Official Oppression (Texas Penal Code § 39.03), Abuse of Official Capacity (Texas Penal Code § 39.02), and included in all Brady disclosures. The officers should be charged with Conspiracy Against Rights (18 U.S.C. § 241) and included in all Brady disclosures.
